Using the Shark Tank TV format, Trustees will propose ethical dilemmas and advocate that our panel of Bankruptcy Judges adopt certain propositions. Through pointed questions by our Judges ('Sharks") to the Trustees ("Minnows"), and the Trustee answers given, the ethical dilemma of the propositions and the Model Rules will be discussed and resolved. The presentation will include such topics as 1. Third Party Litigation Financing. (Model Rules 1.1, 1.3, 1.4, 5.4, and 1.8); 2. Debtor Suits Against Trustee and Sanctions. (1.7, 3.7, and 3.4); 3. Adventures in Facilitating (3.3) ; 4. Codification of a Trustee's Power to Waive Debtor's Attorney-Client Privilege (1.6); 5. A Statutory Fix to In re Lamie v. Trustee. ( 1.5(a), 1.7(a), 8.4(c)(d) ) ; 6. Funds Paid and Returned to Trustees, What about the Commissions ? ( 1.5 (a), 1.5, and 8.4 ); 7. Modification of Bankruptcy Rule 2014 - to Require More Disclosures (Model Rules 8.3, 1.7, and 1.10 )
